Movers Docklands Terms and Conditions of Service
These Terms and Conditions set out the basis on which Movers Docklands provides removal and related services within the United Kingdom. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings given below:
1.1 Client means the individual, company or organisation that requests or pays for the services.
1.2 Services means removal, packing, unpacking, loading, unloading, transport, storage, or any related services provided by Movers Docklands.
1.3 Goods means all items, belongings, furniture, personal effects, equipment and any other property which are the subject of the services.
1.4 Contract means the agreement between Movers Docklands and the Client incorporating these Terms and Conditions and any written quotation or confirmation.
1.5 Working Day means any day other than a Saturday, Sunday or public holiday in England.
2. Scope of Services
2.1 Movers Docklands provides domestic and commercial removal services, including but not limited to local moves, packing and unpacking, loading and unloading, and transport of goods between specified addresses.
2.2 Any additional services, such as disassembly or reassembly of furniture, provision of packing materials, or storage, will be provided only if expressly agreed in advance and may incur additional charges.
2.3 Services are provided subject to accessibility, parking availability, property conditions and any local restrictions that may apply. The Client is responsible for ensuring that access is suitable for the safe completion of the services.
3. Booking Process
3.1 Bookings may be made by the Client through our accepted booking channels. A booking is only confirmed when Movers Docklands issues written confirmation of the date, time, and agreed services.
3.2 Quotations are based on the information supplied by the Client, including property size, volume of goods, access conditions, distance, and any special requirements. The Client must provide accurate and complete information.
3.3 Movers Docklands reserves the right to revise or withdraw a quotation if:
(a) the Client has provided incomplete or inaccurate information; or
(b) the services are not booked within the timeframe specified in the quotation; or
(c) there is any significant change to the scope of work, including changes to addresses, access, or the nature or volume of goods.
3.4 Any estimated time for completion of the services is an approximation only and does not form a binding guarantee. Movers Docklands is not liable for loss or damage arising from any delay caused by events beyond its reasonable control.
4. Client Obligations
4.1 The Client must ensure that:
(a) all goods are prepared for removal in a suitable manner unless packing services are included;
(b) items are properly packed and secured where the Client undertakes the packing;
(c) all fragile or high-value items are clearly identified to our team prior to loading;
(d) all items to be moved are ready for collection on the agreed date and time;
(e) appropriate parking and access are available at collection and delivery addresses, and any required permits are obtained in advance.
4.2 The Client must be present or represented at the collection and delivery addresses to provide access, directions, and confirmation of the goods to be moved and their condition.
4.3 The Client warrants that they are the owner of the goods, or have full authority from the owner to enter into the contract. The Client shall indemnify Movers Docklands against any claim from a third party alleging ownership or superior rights to the goods.
5. Items Not Accepted for Removal
5.1 Movers Docklands will not carry, store or handle the following items:
(a) hazardous or dangerous goods, including but not limited to explosives, flammable substances, gas cylinders, chemicals, paints and solvents;
(b) illegal items or goods obtained unlawfully;
(c) perishable goods or living plants and animals requiring special conditions;
(d) items of extraordinary value, including but not limited to jewellery, watches, precious metals, securities, cash, important documents and collections, unless specifically agreed in writing.
5.2 If any such items are transported or stored without Movers Docklands knowledge, this is entirely at the Client's risk and Movers Docklands accepts no liability for loss, damage or deterioration.
6. Payments and Charges
6.1 Prices are normally quoted based on a fixed fee or hourly rate plus any additional agreed charges such as congestion charges, tolls, parking costs, and materials. All charges are stated exclusive of any applicable taxes unless otherwise specified.
6.2 Movers Docklands may require a deposit to secure the booking. The amount and due date of any deposit will be notified at the time of booking.
6.3 Unless otherwise agreed in writing, the balance of the charges is due on or before completion of the services on the moving day.
6.4 Payment must be made using an accepted method. The Client is responsible for ensuring that any payment method has sufficient funds or credit available.
6.5 If the Client fails to pay any amounts due, Movers Docklands reserves the right to:
(a) suspend or refuse to carry out any further services;
(b) charge interest on overdue amounts at the statutory rate permitted under the Late Payment of Commercial Debts legislation or, where not applicable, at a reasonable rate;
(c) retain the goods until full payment is received, subject to any applicable legal requirements.
7. Cancellations and Postponements
7.1 The Client may cancel or postpone the services by giving written notice to Movers Docklands.
7.2 Where a cancellation or postponement is received more than seven Working Days before the scheduled service date, any deposit paid may be refunded or transferred, subject to reasonable administrative charges.
7.3 Where a cancellation or postponement is received between three and seven Working Days before the scheduled service date, Movers Docklands reserves the right to charge up to fifty percent of the quoted price.
7.4 Where a cancellation or postponement is received less than three Working Days before the scheduled service date, Movers Docklands reserves the right to charge up to the full quoted price.
7.5 If Movers Docklands is unable to perform the services on the agreed date due to circumstances beyond its reasonable control, including severe weather, accidents, road closures, industrial action, or sudden staff illness, the services may be rearranged to a mutually convenient date. Movers Docklands is not liable for any consequential losses resulting from such rescheduling.
8. Client Delays and Additional Work
8.1 If the services are delayed or extended due to reasons within the Client's control, including but not limited to inadequate access, items not being packed, waiting for keys or completion, or inaccurate information regarding volume, Movers Docklands reserves the right to charge reasonable additional fees based on the standard hourly rate and any extra costs incurred.
8.2 Where the scope of work changes on the day of the move, such as additional items, extra stops, or unexpected dismantling or reassembly, Movers Docklands may adjust the charges accordingly.
9. Liability for Loss or Damage
9.1 Movers Docklands will exercise reasonable care and skill in handling, loading, transporting and unloading the goods.
9.2 Subject to the exclusions and limitations in these Terms and Conditions, Movers Docklands accepts liability for physical loss of, or damage to, goods during the performance of the services, to the extent caused by our negligence or breach of contract.
9.3 Movers Docklands shall not be liable for:
(a) loss or damage arising from faulty or insecure packing carried out by the Client;
(b) deterioration of fragile or perishable goods;
(c) damage to goods already defective, weakened, or in poor condition;
(d) loss of data, software, or digital content from computers or electronic devices.
9.4 Movers Docklands is not liable for any indirect or consequential losses, including loss of profits, business interruption, or loss of opportunity, arising out of or in connection with the services.
9.5 In the event of a valid claim for loss or damage, Movers Docklands liability shall be limited to the lower of the cost of repair, the current market value of the goods, or any agreed liability limit set out in the quotation or confirmation.
10. Damage to Property
10.1 Movers Docklands will take reasonable care to avoid damage to property during the performance of the services.
10.2 The Client must ensure that floors, walls, doors and other surfaces are adequately protected where necessary. Movers Docklands is not liable for normal wear and tear or scuffing that may reasonably occur in the course of moving large or heavy items.
10.3 Any damage to property must be reported to Movers Docklands in writing as soon as practicable and in any event within seven days of completion of the services, accompanied by reasonable evidence.
11. Claims and Notification
11.1 Any claim for loss or damage to goods must be notified to Movers Docklands in writing as soon as reasonably possible and in any event within seven days of the completion of the services.
11.2 The Client must provide details of the items affected, the nature and extent of the damage or loss, and any supporting documentation or images reasonably requested by Movers Docklands.
11.3 Failure to notify within the specified period may prejudice Movers Docklands ability to investigate and may affect the outcome of the claim, although statutory rights are not excluded.
12. Waste Regulations and Disposal
12.1 Movers Docklands is not a licensed waste carrier for general refuse unless explicitly stated and will only remove unwanted items or waste where this has been agreed in advance and complies with applicable waste and environmental regulations.
12.2 The Client is responsible for declaring any items intended for disposal and for ensuring that such items are lawful to dispose of. Prohibited or hazardous waste will not be collected.
12.3 Where Movers Docklands agrees to remove items for disposal or recycling, the Client authorises Movers Docklands to determine the method of disposal in compliance with relevant regulations, including the use of licensed waste transfer facilities or recycling centres.
12.4 Additional charges may apply for the removal of bulky items, specialist disposal, or items subject to particular waste controls such as electrical appliances or materials requiring segregation.
12.5 The Client remains responsible for any waste left behind at the property that was not expressly included in the agreed services.
13. Insurance
13.1 Movers Docklands maintains appropriate insurance in connection with the provision of its services as required by law and industry practice.
13.2 The Client is encouraged to arrange adequate insurance cover for their goods, especially for high-value or fragile items, as Movers Docklands liability is limited as set out in these Terms and Conditions.
14. Subcontracting
14.1 Movers Docklands reserves the right to subcontract all or any part of the services to reputable third parties, provided that Movers Docklands remains responsible for the proper performance of the contract.
14.2 These Terms and Conditions apply equally to any subcontractor engaged by Movers Docklands.
15. Data Protection and Privacy
15.1 Movers Docklands will process personal data provided by the Client in accordance with applicable data protection laws.
15.2 Personal information is collected and used for the purposes of managing bookings, performing the services, processing payments, handling claims, and complying with legal obligations.
15.3 Movers Docklands will take reasonable steps to keep personal information secure and will not sell or disclose it to third parties except where necessary to perform the contract, comply with law, or where the Client has given consent.
16. Termination
16.1 Either party may terminate the contract with immediate effect by written notice if the other party commits a material breach of these Terms and Conditions and fails to remedy that breach within a reasonable period after being notified.
16.2 Movers Docklands may terminate the contract immediately if it reasonably believes that carrying out the services would be unlawful, unsafe, or expose its staff to unacceptable risk.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided by Movers Docklands.
18. General Provisions
18.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
18.2 No failure or delay by Movers Docklands in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
18.3 The Client may not assign or transfer any of their rights or obligations under the contract without the prior written consent of Movers Docklands.
18.4 These Terms and Conditions, together with any written quotation or confirmation, constitute the entire agreement between the parties in relation to the services and supersede any prior understandings or agreements.
18.5 Movers Docklands reserves the right to amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the contract with the Client.
